The domain name www.tranzily.com ( "Website") is owned by TRANSPURE Solutions Pvt Ltd, (TRANSPURE) a company incorporated in India with its corporate office at 1st Floor , 51/65, Rajbaug Estate, Pydhonie, Mumbai, Maharashtra, 400003. The domain name www.tranzily.com and the company name Transpure will be used interchangeably.

This website www.tranzily.com acts as a mere venue/platform for our Agent Partners to negotiate/interact for undertaking outward remittance and other business services by way of booking orders with our remittance partners to book remittance transactions, through this platform.

We do not take part in the actual transaction that takes place between the Remitter ( Customer) and Processor ( AD I or AD II) and hence are not a party to any such contract for sale negotiated between buyers and sellers. All transactions will be the responsibility of the consumers/customers and users only. The contents of this site, including but not limited to the text and images herein and their arrangements, unless otherwise noted, are Copyright in the whole and every part of this site belongs to TRANSPURE, unless otherwise indicated, and may not be used, sold, licensed, copied or reproduced in whole or in part in any manner or form or in or on any media to any person without the prior written consent of TRANSPURE.

Foreign exchange transactions are subject to a maximum transaction limit as prescribed by the Reserve Bank of India (RBI) in respect of Foreign exchange drawing rights under the Liberalized Remittance Scheme (LRS).

The rates provided to you on www.tranzily.com are from the Remittance Partners directly and are representative of the macroeconomic conditions and the cost structure of the Remittance Partner.

The exchange rates given at www.tranzily.com are valid for that point in time only, and applicable rates would be the ones that are given after the remitter's KYC is validated. After the booking confirmation, the agreed rate will be valid for a period of 4 hours or until the prescribed cut-off time as communicated on transaction emails/correspondence.

The quotes provided by Transpure are exclusive of any government tax like Goods and Service tax, charges, and levies which will be charged at actuals.

Any requirement received during non-working hours will be attended to on the next working day.

In case you have a requirement of more than one currency, then you will have to place separate requests for each currency.

You are required to provide proof of identity, proof of residence, and proof of travel or any other documentation to the authorized dealer as required by the RBI in order to undertake any Foreign Exchange remittance transaction.

If you wish to amend/ change a transaction that has already been submitted on www.tranzily.com first you will need to cancel the transaction and then re-book a new one on the website.

Agent partners expressly agree that their contact details can be shared with the authorized dealer who will service your transaction. Additionally, your contact details can be used to provide you with any information about www.tranzily.com

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a user of the TRANSPURE website and shall not transact on or use the website.

As a minor, if you wish to use or transact on the website, such use or transaction may be made by your legal guardian or parents on the Website. Transpure reserves the right to terminate your registration and/or refuse to provide you with access to the Website if it is brought to Transpure notice or if it is discovered that you are under the age of 18 years.

The Website is a platform that Agent Partners use to interact with Remittance Partners (Autherised Dealers) for their transactions or initiating transactions on the behalf of their customers. TRANSPURE is not and cannot be a party to or control in any manner any transaction between the Website's Users.

All commercial terms are offered and before confirming the order are agreed between Agent Partners and Autherised Dealers alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to services, and after-sales services. TRANSPURE does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Customers and Authorized Dealers.

Transpure is not responsible for any non-performance or breach of any contract entered into between Customers and Authorized Dealers. TRANSPURE cannot and does not guarantee that the concerned Customers and Authorized Dealers will perform any transaction concluded on the Website. Transpure shall not and is not required to mediate or resolve any dispute or disagreement between Customers and Authorized Dealers. Transpure does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc) of any of its Users. You are advised to independently verify the bona fides of any particular User that You choose to deal with on the Website and use Your best judgment on that behalf.

TRANSPURE does not at any point of time during any transaction between Customer and Authorized Dealers on the Website come into or take possession of any of the products or services offered by Seller nor does it at any point gain title to or have any rights or claims over the products or services offered by Authorized Dealers to Customers.

At no time shall TRANSPURE hold any right, title, or interest over the products nor shall TRANSPURE have any obligations or liabilities in respect of such contracts entered into between Customers and Authorized Dealers. TRANSPURE is not responsible for the unsatisfactory or delayed performance of services or delays as a result of currencies that are out of stock, unavailable, or back-ordered.

The customer agrees to release and indemnify TRANSPURE and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Website and specifically waive any claims that you may have in this behalf under any applicable law.

This service is only available for Indian Nationals residing in India.

Forex rates provided on our platform are indicative and are subject to change as per the international market trading scenarios. The final rate applicable to your transaction will be the rate prevailing at the time your money reflects with the authorized dealer.

TRANSPURE is a technology service provider for Remittance services and our agent partners may collect payment in part or in full for foreign exchange services ( Remittance) on behalf of its remittance partner (Autherised Dealer -AD). Remittance Partners (AD) are the executors of all such transactions and all payments collected are routed through to the dealer's bank accounts, less the service fee (if applicable) levied by TRANSPURE.

By paying on the platform, the Customer/Entity completing the payment explicitly agrees that the payment for the foreign exchange is being made from his/her/the entity's own funds and that all persons availing forex is bonafide resident Indian and is eligible to draw foreign exchange under FEMA,1999.

For transactions canceled on the customer's request or non-compliance with the KYC Regulations by the customer, the amount will be refunded after deduction of payment gateway charges and cancellation charges (if applicable).

Payment Gateway charge is a fee also known as 'Merchant Service fee', and is applicable for all transactions where the customer makes payment online. Currently, this fee varies from one mode of payment to another and is subject to change as decided by the respective Payment Gateway.

Cancellation charges are arrived at www. TRANSPURE.com in consultation with the respective authorized dealer (executor of the transaction) and shall cover any losses which might be incurred by either party. Refunds are processed within 3 working days of receiving a request from the customer.

Agent Partnership on the Website is free for Customers. TRANSPURE does not charge any fee for browsing and buying on the Website. TRANSPURE reserves the right to change its Fee Policy from time to time. In particular, TRANSPURE may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event TRANSPURE reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be.

Changes to the Fee Policy shall be configured on the setup and such changes shall automatically become effective immediately after they are configured on the setup. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws for making payments through www.Tranzily.com.

Both the parties will keep confidential all the privileged information which the other party receives during the course of business. The confidential information will not include the publically available, known to the receiving party prior, or rightfully acquired by receiving party from third party, or independently developed, to be imparted under obligation to Regulatory, Law Enforcement Agencies or applicable jurisdiction by giving reasonable advance notices to the disclosing party.

In no event shall TRANSPURE its subsidiaries, affiliates, associate companies, accountants, advisors, agents, consultants, contractors, partners and/ or suppliers and their respective officers, agents, directors be liable with respect to the Webpage, products, and/ or any services hereunder:

For any amount in the aggregate in excess of the price paid by User; or for any indirect, incidental, punitive, or consequential damages of any kind whatsoever including but not limited to loss of use, revenue or profit, goodwill and/ or other intangible losses arising out of or in any way connected with the use of this Webpage, Products and/ or the services and/ or the Agreement or with the delay or inability to use this Webpage, or for any information, materials and/ or Products uploaded, posted, emailed, transmitted and/ or obtained through this Webpage, or otherwise arising out of the use of this Webpage, whether based on contract, tort, negligence, strict liability or otherwise, even if Sellers, subsidiaries, affiliates, associate companies, partners and/ or suppliers had been advised of the possibility of damages. IN NO EVENT SHALL TRANSPURE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF USE, EVEN IF USER HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

In the event either party is unable to perform its obligations under the stated terms and condition because of acts of God, natural disaster, strikes, equipment or transmission failure, change in the regulation or damage reasonably beyond its control, or other causes reasonably beyond its control, except for the payment to the services delivered, such party shall not be liable for damages to the other for any damages resulting from such failure to perform or otherwise from such causes. The affected party will expeditiously inform the other party of the magnitude of the circumstance of the occurrence of Force Majeure.

A written announcement, information or demand personally delivered , if mailed by a postal service or courier service with or without a return receipt to the other party's registered address.

You shall indemnify and hold harmless TRANSPURE, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy, and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. All disputes arising out of, or in connection with the Agent Partnership Agreement would be subject to the exclusive jurisdiction of the Courts of Mumbai, India.

Unless otherwise specified, the material on the Website is presented solely for the purpose of sale in India. TRANSPURE makes no representation that materials in the Website are appropriate or available for use in other locations/Countries other than India. Those who choose to access this site from other locations/Countries other than India do so on their own initiative and TRANSPURE is not responsible for the supply of products/refund for the products ordered from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable.
